Police in San Jose arrested Smith on Friday morning on suspicion of DUI after a single-car accident around 7 a.m. Smith was not injured, and was taken to Santa Clara County Jail. He is also facing a charge of possession of marijuana,
according to the Santa Clara County Sheriff's Office.
Smith was released after posting a $5,250 bond, and reported to the Niners' training facility in nearby Santa Clara in time for Friday's practice.
This is Smith's second arrest on a drunken driving charge, though charges from his January 2012 arrest in Miami Beach were reduced to reckless driving. The NFL typically does not punish players for a first DUI, but a second arrest could trigger a two-game suspension, like the one the NFL recently slapped on Minnesota fullback Jerome Felton.
